न्‍यायालय के अनुसार आदिवासी हिन्‍दु नही है

भारत में समय-समय पर विभिन्‍न राज्‍यों की हाईकोर्ट ने अपने महत्‍वपूर्ण निर्णयों में साबित किया है कि आदिवास‍ियों पर हिन्‍दु विवाह अधिनियम 1955 लागु नही होता है।

क्‍यों लागु नही होता है ? सोचने की बात है।

क्‍या आदिवासी हिन्‍दु नही है ? नहीं है।

इसलिये तो हिन्‍दु विवाह अधिनियम आदिवासी पर लागु नही होता है।

आइये देखते है कुछ केस -

 

(1) Jharkhand High Court,

अनुसूचित जनजाति पर हिन्‍दु विवाह अधिनियम 1955 लागु नही पडता है।

the second marriage is permissible according to the customs of the Gond community and further as to whether the provisions of Hindu Marriage Act are not applicable upon the parties.

अर्थात गोन्‍ड समूदाय में दूसरा विवाह मान्‍य है और इस समूदाय पर हिन्‍दु विवाह अधिनियम लागु नही होता है

इस केस में केरल हाई कोर्ट ने अपने पाइन्‍ट नम्‍बर 6 में लिखा है कि-

"Hindu Marriage Act is not applicable to the members of the Scheduled Tribe as per Section 2(2) of the Hindu Marriage Act. If that be so, the directions issued by the Family Court under Section 9 of the Hindu Marriage Act is not applicable to the appellant."

अर्थात हिन्‍दु विवाह अधिनियम के सेक्‍सन 2(2) के तहत हिन्‍दु विवाह अधिनियम अनुसूचित जनजााति के लाेगों पर लागु नही होते है।

 

...The tribal people observe their festivals, which have no direct conflict with any religion, and they conduct marriage among them according to their tribal custom.

They have their own way of life to maintain all privileges in matters connected with marriage and succession, according to their customary tribal faith.

In "Law Enforcement in Tribal Areas" by S.K. Ghosh, Director, Law Institute, Calcutta, published by Ashish Publishing House at page 89 it is stated that though the Hindu Succession Act 1956 Hindu marriage Act 1954, Hindu Adoption and Maintenance Act 1956 did not apply, because of their contracts with other advanced societies some changes have taken place among tribes in the observance of marriage, divorce, etc.
